1. Introduction

Welcome to Lunch Hero ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Lunch Hero website, mobile application, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

2. Account Registration

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.

3. Subscription Plans

Lunch Hero offers subscription plans (Basic, Plus, Max) and a one-time Lifetime Access option. Recurring subscriptions automatically renew until you cancel. You can cancel at any time; access continues until the end of your current billing cycle. Cancellation and refunds may be handled through your account settings (web and iOS) or through Google Play (Android), as described below.

Recurring plans: Basic, Plus, and Max have specific limits on the number of child profiles and meal plan generations as specified in the application. These plans renew automatically unless you turn off renewal in your account or, on Android, in Google Play.

Lifetime Access: Lifetime Access is a one-time payment (e.g., $99.99) for ongoing access to Plus-level features. It does not auto-renew and has no recurring charges. It may be offered for a limited time; availability may change. "Lifetime" means for the lifetime of the Lunch Hero service (or as long as we make the service available) and includes Plus-level features only; it does not include future tiers (e.g., Max) unless we state otherwise. Lifetime purchases are final and non-refundable except where required by law.

Payment by platform: On our website and on iOS, subscriptions and one-time purchases (including Lifetime) are processed by Stripe; cancellation and refund requests are handled through your account or by contacting us. On Android, subscriptions and in-app purchases are processed by Google Play. Payment, cancellation, refunds, and subscription management for Android may be governed by Google Play's terms and policies, and you may need to manage or cancel through the Google Play Store or your device settings.

4. Payment Methods and Third-Party Processors

Payments may be processed by third-party payment processors (e.g., Stripe, Apple, Google). By completing a purchase, you may also be subject to the applicable processor's terms. We do not store full payment card details; payment processing and storage of payment data are handled by these processors.

5. User Content

You retain ownership of any content you submit to the Service, including meal preferences, allergies, and other information. By submitting content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content for the purpose of providing and improving the Service.

6. Meal Plans and Shopping Lists

Lunch Hero provides AI-generated meal plans and shopping lists based on the information you provide. While we strive for accuracy, we do not guarantee that the meal plans will be free from error or meet your specific nutritional needs. You are responsible for reviewing the meal plans for any allergies or dietary restrictions that apply to you or your children.

7. Instacart Integration

For Max tier subscribers, we offer integration with Instacart. To use this feature, you will need to provide your Instacart account information. We use secure methods to store this information, but we cannot be held responsible for any issues with Instacart's services or changes in their API or terms.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and disclose information about you.

9. Changes to Terms

We may modify these Terms at any time. If we make changes, we will provide notice of such changes, such as by sending an email, providing a notice through the Service, or updating the date at the top of these Terms. Your continued use of the Service after the revised Terms have been posted indicates your acceptance of the changes.

10. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service will immediately cease.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUNCH HERO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
